PACT ACT / STORE CLOSURE UPDATE

3/19/2021

At the end of 2020, the U.S. Congress passed a rule that updates the Prevent All Cigarette Trafficking Act, also known as the PACT Act, to now include e-cigarettes and vapor products.  As a result, beginning April 27th, 2021, vaping products will now be considered tobacco products and cannot be shipped via the United States Postal Service (USPS) directly to consumers.  Both Fedex and UPS have followed suit and will also halt shipping any vapor products beginning March 1st, 2021 and April 5th, 2021 respectively.

Essentially, all vaping products are now subject to the same shipping restrictions as traditional cigarettes, pipe tobacco, and other tobacco products.  In addition to these shipping bans, the PACT Act / Jenkins Act imposes series of stringent requirements on shippers locally to be able to continue delivering vaping products within the U.S.  Additionally, any online seller is NOW REQUIRED to collect the appropriate sales tax plus any tobacco / vapor excise taxes.  Due to the complexity of the huge variety in tax rates from state to state or city to city, we will NOT be able to comply with these new regulations in a timely manner at this current moment.

With the sheer volume of incoming orders stemming from the panic created by the updated PACT Act along with our very limited staff, we anticipate that we will have to shut down the site from any new orders as early as 12:00 P.M. EST on March 24th, 2021.  Any orders placed by this time frame should ship out on the last day we can ship, which is March 26th, 2021.

For more information regarding the new rules and regulation, please visit the Consumer Advocates for Smoke-Free Alternatives Association (CASAA) site.  Additionally, if you’d like to take action, the U.S.P.S. is currently seeking comments on how this will impact both businesses and end users since they do not have a complete understanding of the vape industry.  Example comments would include if you live in a rural area with no access to a local vape shop or have any concerns for increased exposure to COVID-19 by visiting your local vape shop.  We strongly advise for you comment during this period and explain how it affects you.  You can do so using the link below:
